Terms & Conditions of Service and Hire of The Creative Duo Sydney
THE CREATIVE DUO
Terms & Conditions
By accepting a quotation, paying a deposit, or engaging the services of The Creative
Duo, the Client acknowledges and agrees to the following Terms & Conditions.
1. Definitions
"The Creative Duo" refers to The Creative Duo and its employees, contractors and
representatives.
"Client" refers to the individual, company or organisation engaging the services of The
Creative Duo.
"Services" includes, but is not limited to, prop hire, artificial floral hire, event styling,
installations, delivery, setup and pack-down services. ---
2. Booking Confirmation & Deposits
2.1 A booking is not confirmed until the required deposit has been received.
2.2 The Creative Duo reserves the right to release a booking date and any reserved
inventory if the deposit is not paid by the specified due date.
2.3 Deposits are non-refundable and non-transferable.
2.4 Acceptance of a quotation and/or payment of a deposit constitutes acceptance of
these Terms & Conditions.

3. Final Payment
3.1 Full payment must be received no later than fourteen (14) days prior to the event
date unless otherwise agreed in writing.
3.2 Failure to make payment by the due date may result in cancellation of services
without notice.
3.3 The Creative Duo reserves the right to withhold delivery, installation or hire items
until all outstanding balances have been paid in full.

4. Cancellations & Date Changes
4.1 All deposits are strictly non-refundable.
4.2 If the Client cancels more than sixty (60) days prior to the event date, the deposit will
be retained and any additional payments may be refunded at the discretion of The
Creative Duo.
4.3 If the Client cancels between thirty (30) and sixty (60) days prior to the event date,
fifty percent (50%) of the total booking value will be retained.
4.4 If the Client cancels within thirty (30) days of the event date, one hundred percent
(100%) of the total booking value will be forfeited.
4.5 Requests to change an event date are subject to availability and may incur
additional fees.
4.6 If a requested new date is unavailable, the cancellation policy will apply.

5. Design Concepts, Mock-Ups & Creative Direction
5.1 The Creative Duo may, at its sole discretion, provide digital mock-ups, sketches,
mood boards, concept imagery, renderings or visual guides.
5.2 Such materials are intended as a conceptual representation only and are not an
exact depiction of the final installation.
5.3 The final design may vary due to venue conditions, stock availability, installation
requirements, weather conditions, artistic interpretation, safety considerations and
other practical factors.
5.4 The provision of a digital mock-up is not included in all packages and is not a
mandatory component of the design process.
5.5 The Creative Duo reserves the right to make reasonable design modifications while
maintaining the overall style and aesthetic of the agreed concept.

6. Artistic Licence
6.1 The Client acknowledges that The Creative Duo provides bespoke creative services
and grants The Creative Duo reasonable artistic discretion in the execution of all
designs.
6.2 While every effort will be made to incorporate the Client's preferences, The Creative
Duo does not guarantee exact replication of inspiration images, Pinterest images, social
media content, AI-generated concepts or previous installations.

7. Product Availability & Substitutions
7.1 In the event that specific props, florals, vessels, structures or styling items become
unavailable, The Creative Duo reserves the right to substitute items of similar style,
quality, colour and value.
7.2 Such substitutions shall not constitute a breach of contract and shall not be
grounds for cancellation or refund.

8. Venue Access Requirements
8.1 The Client is responsible for providing accurate venue information prior to the event.
8.2 This includes, but is not limited to:
• Stair access
• Lift availability
• Restricted loading zones
• Long carrying distances
• Uneven surfaces
• Difficult terrain
• Limited parking
• Restricted bump-in or bump-out times
• Access limitations imposed by the venue
8.3 Failure to disclose relevant venue information may result in additional labour,
transport, equipment or installation fees.
8.4 The Creative Duo reserves the right to refuse installation where access conditions
pose a safety risk or make installation impractical.

9. Delivery, Travel & Venue Changes
9.1 Quoted travel fees are based on the information provided at the time of booking.
9.2 Additional travel charges may apply if:
• The venue location changes
• Delivery times change significantly
• Multiple delivery locations are required
• Additional site visits become necessary
9.3 Any venue changes must be communicated as soon as reasonably possible.

10. Outdoor Installations & Weather
10.1 Outdoor installations are undertaken at the Client's risk.
10.2 The Client is responsible for ensuring a suitable wet weather backup location is
available where required.
10.3 The Creative Duo reserves the right to modify, relocate, secure or remove
installations if weather conditions are deemed unsafe.
10.4 No refunds will be provided for weather-related modifications, delays or
cancellations outside the reasonable control of The Creative Duo.

11. Hire Items, Damage & Loss
11.1 All hired items remain the property of The Creative Duo at all times.
11.2 Responsibility for hired items transfers to the Client upon delivery and remains
with the Client until collection.
11.3 The Client is responsible for any loss, theft, breakage, staining, damage or misuse
of hired items.
11.4 Damaged or missing items will be charged at their full replacement value,
including any associated labour, sourcing and freight costs.
11.5 Cleaning fees may apply where items are returned in an excessively dirty condition. ---
12. Guest & Third-Party Interference
12.1 The Creative Duo is not responsible for damage caused by guests, venue staff,
contractors, suppliers or other third parties.
12.2 No refunds will be provided where installations are altered, moved, dismantled or
damaged by any person other than The Creative Duo.

13. Collection of Hire Items
13.1 Hired items must remain at the agreed venue until collected by The Creative Duo
unless otherwise agreed in writing.
13.2 The Client must ensure reasonable access for collection at the agreed time.
13.3 Additional fees may apply where collection is delayed or access is restricted.

14. Delays
14.1 The Creative Duo shall not be liable for delays caused by venues, suppliers,
contractors, traffic conditions, weather events or other circumstances beyond its
control.
14.2 Additional labour charges may apply where delays significantly impact installation
or collection schedules.

15. Photography & Marketing
15.1 The Creative Duo reserves the right to photograph, and film completed
installations and events.
15.2 Such content may be used for marketing, portfolio, website, advertising and social
media purposes unless otherwise agreed in writing prior to the event. ---
16. Intellectual Property
16.1 All designs, concepts, styling plans, digital mock-ups, renderings, proposals,
photographs and creative materials produced by The Creative Duo remain the
intellectual property of The Creative Duo.
16.2 These materials may not be copied, reproduced, distributed, sold or used for
commercial purposes without prior written consent.

17. Safety
17.1 The Creative Duo reserves the right to decline, modify or cease services where
circumstances arise that may compromise the safety of staff, clients, guests, venues,
hired items or installations.
17.2 The Client agrees to provide a safe working environment for installation and pack
down personnel.

18. Limitation of Liability
18.1 To the maximum extent permitted by law, The Creative Duo shall not be liable for
indirect, consequential or incidental losses arising from the provision of its services.
18.2 The Creative Duo's liability shall be limited to the amount paid by the Client for the
affected services.

19. Force Majeure
19.1 The Creative Duo shall not be liable for any failure to perform its obligations due to
circumstances beyond its reasonable control, including but not limited to natural
disasters, extreme weather, venue closures, government restrictions, transportation
disruptions, illness, accidents or other unforeseen events.

20. Candle Hire & Safety
20.1 The Creative Duo provides candles for decorative purposes only. The Client
acknowledges that lit candles present a fire hazard and agrees to ensure that all
candles are used safely and in accordance with venue regulations and local fire safety
requirements.
20.2 The Client assumes full responsibility for the supervision, use, and safety of all
candles from the time of setup until collection. Candles must not be moved, left
unattended while lit, placed near flammable materials, or used in a manner that may
pose a risk to persons or property.
20.3 The Creative Duo accepts no liability for any injury, loss, damage, fire, or incident
arising from the misuse, relocation, or unsupervised use of candles. Any loss, damage,
breakage, excessive wax spillage, or replacement costs incurred during the hire period
will be the responsibility of the Client and may be charged accordingly.
21. Acceptance
21.1 Payment of a deposit, acceptance of a quotation or engagement of services
constitutes acceptance of these Terms & Conditions in full.
